London Metropolitan University’s licence to sponsor students is withdrawn

The UK Border Agency has revoked (withdrawn) London Metropolitan University's licence to sponsor students from outside the European Union.
The withdrawal of London Metropolitan University's licence means that it is removed from the register of licensed sponsors, and students from outside the European Union are no longer allowed to study at the university.
We understand that international students at London Metropolitan University may be concerned.
London Metropolitan University students who are already in the UK with a current, valid UK visa do not need to do anything immediately.
A government-led taskforce is being created, which will include the Higher Education Funding Council for England (HEFCE), Universities UK, the Department for Business, Innovation and Skills (BIS), the UK Border Agency and the National Union of Students. This will work with London Metropolitan to support those affected and enable appropriately qualified genuine students to find another institution where they can continue their studies in the UK. The taskforce will start work immediately.
If an existing London Metropolitan University student with a current, valid visa is on holiday outside the UK, they can return to the UK.
New students who were planning to travel to the UK to start studying with London Metropolitan University should not travel.
A UK Border Agency spokesperson said:
'These are problems with 1 university, not the whole sector. British universities are among the best in the world - and Britain remains a top-class destination for top-class international students.
'We are doing everything possible, working with the taskforce established by BIS, to assist students that have been affected.'

ILR - Indefinite Leave to Remain in the UK. Permanent Residency
Changes to Indefinite Leave to Remain (ILR) rules on 6th April 2011...
From 6th April 2011, the UK Border Agency has changed the immigration rules for anyone applying for an Indefinite Leave to Remain visa (aka Permanent Residency). There have been two types of changes:
Changes that affect all applicants that are applying for Indefinite Leave to Remain;
Changes that affect only those on a Tier 1, Tier 2 or Work Permit applying for ILR
Changes affecting all applicants
The following two changes affect everyone:
Criminal Convictions – You can no longer apply for Indefinite Leave to Remain if you have been convicted of a crime and not enough time has passed for the conviction to become “spent”. “Spent” is a legal term that means the conviction can no longer be held against you in line with the Rehabilitation of Offenders Act 1974. Most convictions become spent after 5 - 7 years from the date of conviction in court. For an example, this would mean that if you were convicted of a crime once you have spent four years in the UK on a Tier 1 (General) visa, you would have to stay on your Tier 1 visa for another 5 year period before applying for ILR whilst you wait for the conviction to become spent! Please also note that this includes traffic offences such as drink driving or driving without insurance etc. Do not panic if you have any penalty charge notices, parking tickets or fines as these are not criminal convictions
Your wife or husband must have spent 2 years living in the UK with you before they now qualify for Indefinite Leave to Remain – before the changes we just had to declare any dependents and they would be granted ILR with the main applicant regardless of their length of time in the UK. We now have to prove that your husband or wife (dependent) has been living at the same address as you (the main applicant) for no less than 2 years before they can apply for Indefinite Leave to Remain.
Changes affecting clients applying for ILR who are currently on a Tier 1, Tier 2 or Work Permit visa
From 6th April 2011, the UK Border Agency has also specifically changed the process for any Tier 1, Tier 2 or Work Permit visa holder’s applying for Indefinite Leave to Remain (ILR).
Changes affecting Tier 1 visa holders:
As an overview, any Tier 1 (General) clients applying for ILR will now have to satisfy the same points requirement they needed to qualify for their Tier 1 extension (i.e. 75 points if you got your first HSMP/Tier 1 visa before 6th April 2010 or 80 points if after). Effectively, they have combined your Tier 1 extension (yes, another one!) with the ILR process so you MUST make sure that your earnings are high enough in the last 12 months to now qualify for ILR!

Tier 2 visa holders now have to show that their earnings are as high as the minimum salary requirement under the UK Border Agency's "Codes of Practice for Tier 2 Sponsored Workers" (which can be found on their website). For example, this means that if you are working as a Marketing Manager and the minimum salary according to the UKBA is £40,000 per annum, your earnings will have to be £40,000 per annum for you to qualify for ILR.
You must check whether your gross earnings are high enough according to the UKBA's list. If they are not, you will not qualify for Indefinite Leave to Remain.

What is Indefinite Leave to Remain?
Indefinite Leave to Remain (ILR) is also known as "Permanent Residence" and almost all migrants in the UK aim for this visa status. With every type of visa, you are given a limited amount of time that you can lawfully remain in the UK. When your visa expires you will need to either extend your existing visa, switch to another visa or return to your home country. ILR allows a person after a set period of time (depending on the visa they are on – see table below) to make an application to remain in the UK indefinitely. The main benefits of ILR apart from ensuring that a person does not have to return home when their visa expires are as follows:
• No more immigration related restrictions on the business or work that you may do within the UK
• No time limits on the length of your stay in your UK
• You will not have to apply for anymore visa extensions

Recent TB test Screening now for India
Travelling to the UK for 6 months or less does not need to screen for a TB test in
Pre-entry TB screening is only required if you are travelling to the UK for more than 6 months. If you are travelling to the UK for 6 months or less, for example on business, family or tourism visitor visas, you are not required to undergo pre-entry TB screening
Following category visa applicants fall under this screening;
• Settlement visas - from 16 August 2012
• working visas for Tiers 1, 2 and 5 of the points based system (PBS) - from 10
September 2012
• student visas for Tier 4 PBS - from 1 November 2012

Applicants for 2,5,10 years of visiting visa are not required to pass this TB test.

For the year from 6 April 2012 to 5 April 2013, a maximum of 20,700 skilled workers can come to the UK under Tier 2 (General) to do jobs with an annual salary below £150,000.
There is no limit on the number of workers coming to the UK to do jobs with an annual salary of £150,000 or above.

Tier 1 Entrepreneur visa UK
In the absence of HSMP General (Tier 1) for the PSW visa and Student Visa holders, the new Tier 1 Entrepreneur visa is a easy way to extend their stay for initial leave to remain by 3 years and further extension of 2 more years, leading to the indefinite leave to remain.
The parameters qualifying for this Visa are listed as under;
Candidate must meet the point’s requirements of 75 in order to qualify and a mandatory qualification of 10 points for maintenance and the English Language requirement. In absence of mandatory maintenance (10 points) and English requirement ( 10 Points) the application will be failing despite scoring the 75 points.
How are the points awarded:
· 25 points : You must have access to not less than £200,000 or £50,000*
· 25 points : The money must be held in one or more regulated financial institutions
· 25 points : The money must be disposable in the United Kingdom and can be held anywhere in the world by your sponsor.
If you are on a PSW Visa the funds to show are only £50,000 and more.
Under this Tier 1 Ent scheme you can club up with maximum of 2 people whilst making an application. Both the candidates will be awarded with the Visa for 3 years separately. This also allows both the candidates to bring their dependants that is their Spouse and any children's under 18 years of an age.
English Language proficiency ( 10 Points)
Applicants can satisfy the language requirements in the following ways:
· Sit an English Exam (i.e. ILETS) Level C1 or IELTS level 6.5 required
· If you have a degree taught in English. A letter from the University stating that the course full-time degree was taught in English can wave of the IELTS exam. Make sure the start end date of the course, full name, Full-time mode of study, start and end date of the course is listed in the letter from the university or College. The degree completed from the institution moreover must be falling equivalent to a Degree taught in English in the UK. UKNARIC equivalent.
· If you originate from a country where the primary language is English than the requirement of English is waved off
Maintenance ( 10 Points)
Candidates must show the bank balance in their personal account anywhere in the world to meet the maintenance requirements:
£3,100 in personal savings if applying from outside the UK on or after 14 June 2012; or
£900 in personal savings if you are applying from inside the UK on or after 14 June 2012.
All savings must have been held for 90 consecutive days.
Candidates claiming to bring their dependants must show an additional of £1800 for applications after 14 June 2012. For all other dependants, candidates in the UK (in-country) will need to show £600 for applications made on after 14 June 2012.
Length of Leave to Remain
3 years initial Leave to remain is stamped if the visa is switched remaining inside the UK
3 years and 4 months leave to remain is stamped if the Tier 1 visa is obtained from the British High Commission, a diplomatic post in candidate's country.
2 years of extension earned upon the completion of given initial leave to remain as above leading to qualify for the application of Indefinite leave to remain (PR)

The parameters qualifying for this Visa are listed as under;
Candidate must meet the point’s requirements of 75 in order to qualify and a mandatory qualification of 10 points for maintenance and the English Language requirement. In absence of mandatory maintenance (10 points) and English requirement ( 10 Points) the application will be failing despite scoring the 75 points.
How are the points awarded:
· 25 points : You must have access to not less than £200,000 or £50,000*
· 25 points : The money must be held in one or more regulated financial institutions
· 25 points : The money must be disposable in the United Kingdom and can be held anywhere in the world by your sponsor.
If you are on a PSW Visa the funds to show are only £50,000 and more.
Under this Tier 1 Ent scheme you can club up with maximum of 2 people whilst making an application. Both the candidates will be awarded with the Visa for 3 years separately. This also allows both the candidates to bring their dependants that is their Spouse and any children's under 18 years of an age.
English Language proficiency ( 10 Points)
Applicants can satisfy the language requirements in the following ways:
· Sit an English Exam (i.e. ILETS) Level C1 or IELTS level 6.5 required
· If you have a degree taught in English. A letter from the University stating that the course full-time degree was taught in English can wave of the IELTS exam. Make sure the start end date of the course, full name, Full-time mode of study, start and end date of the course is listed in the letter from the university or College. The degree completed from the institution moreover must be falling equivalent to a Degree taught in English in the UK. UKNARIC equivalent.
· If you originate from a country where the primary language is English than the requirement of English is waved off
Maintenance ( 10 Points)
Candidates must show the bank balance in their personal account anywhere in the world to meet the maintenance requirements:
£3,100 in personal savings if applying from outside the UK on or after 14 June 2012; or
£900 in personal savings if you are applying from inside the UK on or after 14 June 2012.
All savings must have been held for 90 consecutive days.
Candidates claiming to bring their dependants must show an additional of £1800 for applications after 14 June 2012. For all other dependants, candidates in the UK (in-country) will need to show £600 for applications made on after 14 June 2012.
Length of Leave to Remain
3 years initial Leave to remain is stamped if the visa is switched remaining inside the UK
3 years and 4 months leave to remain is stamped if the Tier 1 visa is obtained from the British High Commission, a diplomatic post in candidate's country.
2 years of extension earned upon the completion of given initial leave to remain as above leading to qualify for the application of Indefinite leave to remain (PR)
